Decree 123/2020/ND-CP issued on October 19, 2022 with new regulations on the time of applying electronic invoices has raised concerns of many businesses about: Do paper invoices have to be canceled before November 1, 2022? 1. Time to use electronic invoices according to Decree 123/2020/ND-CP
Regarding the effectiveness of Decree 123/2020/ND-CP, Article 59 of this Decree stipulates:

“1. This Decree takes effect from July 1, 2022. Agencies, organizations and individuals that meet the requirements on information technology infrastructure are encouraged to apply the provisions on

electronic invoices and documents of this Decree before July 1, 2022

3. Abolish Clause 2 and Clause 4, Article 35 of Decree No. 119/2018/ND-CP dated September 12, 2018 of the Government regulating electronic invoices from November 1, 2020″

Thus, the mandatory deadline for electronic invoices is July 1, 2022. This regulation is consistent with the Tax Administration Law No. 38/2019/QH14 effective from July 1, 2020 regarding the deadline for applying electronic invoices and documents.

In addition Decree 123/2020 also clearly states

according to the provisions of this Decree and Circular 68/2019/TT-BTC.

2. Do businesses have to cancel paper invoices before November 1, 2022?
According to Decree 119/2018/ND-CP, from November 1, 2022, if a business unit still has paper invoices, it will have to carry out procedures to cancel paper invoices and switch to electronic invoices. However, when the mandatory deadline for applying electronic invoices is postponed to July 1, 2022, will the above regulation still apply?
